The newly-enacted Anti-Age Discrimination Law or Republic Act 10911 will not only prohibit discriminating employees according to age when hiring or promoting, but will also prohibit them from laying off employees when they reach the retirement age of 60.
"With this law, you cannot force the employee to retire. They can avail of the retirement if it is voluntary," Representative Emi Calixto-Rubiano, one of the law's authors, said on ANC's Headstart on Tuesday.
Rubiano maintained, the ones retiring must also be qualified to stay on the job because there are exceptions stipulated in the law wherein contractors may refuse employment because of reasonable factors other than age.
She added, through this law, the company and the employer may bargain between them to settle what is the best scenario for both of them.
According to her, this law will even the playing field for the entire workforce because as long as an employee is qualified, he or she may be hired, disregarding factors like age.
"I think now, just looking at the classified ads, there are many opportunities for the younger people. This is just to give equal chances and opportunities to all the people," she said.
